Conditions of Use · Padelground Forest Glen
These terms apply to all bookings, memberships and services at Padelground Forest Glen (ACN 693 619 224) of 84 Sandalwood Lane, Forest Glen QLD 4556 (“Padelground”, “we”, “us”). By making a booking, holding a membership, or using our facilities, you agree to these terms.
1. Booking Terms
A confirmed booking constitutes a binding agreement between you and Padelground, subject to your rights under the Australian Consumer Law. All prices displayed are in Australian Dollars (AUD) and include GST. Payment is required at the time of booking via wallet credit, debit/credit card, or split payment.
Our obligations. We will use due care and skill to provide the booked court, session or facility in a condition reasonably fit for its purpose. Where we cancel a booking, or a court or facility is unavailable or unfit for use due to a fault on our part, you are entitled to a full refund to your wallet or original payment method, or a rescheduled session, at your election.
Arrival and late starts. Please arrive at least 5 minutes before your start time. Late arrivals do not extend the booking — your session ends at the scheduled time.
No-shows. A “no-show” is a booking you neither attend nor cancel. Three (3) or more no-shows in any rolling 90-day period may result in a temporary restriction on advance bookings for up to 30 days. We will notify you before applying any restriction.
Reserved and premium courts. From time to time we may reserve, feature or set aside specific courts (including show courts) for group bookings, events or other purposes. While a court is reserved in this way, it will not be available to book through the booking system. We may also make certain courts available at prices higher than our standard court rates; where a court is offered at such a rate, standard member booking rates and any member court rate or discount do not apply to that court.
Tournaments and events. Padelground may host local, national or international tournaments, competitions or events at the club. During these periods, some or all courts may be unavailable and members may not be able to book courts for casual play. Your membership continues in full during these periods despite any court unavailability, and no refund, credit or fee adjustment is payable for unavailability arising from tournaments or events.
2. Cancellation & Rescheduling
Cancellation and rescheduling windows are determined by your membership level:

These windows apply to individual booking cancellations and are separate from membership cancellation (clause 3).
Outside your window: cancellations and reschedules made outside your window receive a full wallet refund.
Within your window: cancellations made within your window are non-refundable. This applies to member-initiated cancellations only. It does not apply where Padelground cancels, or where a court or facility is unavailable or unfit due to our fault — in those cases you receive a full refund or reschedule (see clause 1 and the ACL note below).
Australian Consumer Law: Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be lawfully excluded, restricted or modified. Where Padelground fails to provide a service with due care and skill, or a service is not fit for its stated purpose, you may be entitled to a remedy regardless of the cancellation or refund rules.
3. Memberships
Padelground offers the following memberships:

Your weekly rate (both All Club options) is set at the rate available when you join (introductory Founder pricing, available in limited numbers) and, if you secure an allocated Founders membership, locks at that rate for your continuous membership, subject to the price-change clause below.
Grounds Pass. Grounds Pass is a 12-month membership. The $395 joining payment covers your first 12 months and includes $395 of wallet credit, redeemable for bookings and services at Padelground. To continue beyond the first year, a $100 annual renewal applies. If you do not renew, your membership benefits stop, but any wallet credit you hold does not expire and remains available to use (see clause 5). Wallet credit is stored value: it does not expire, and is redeemable for services at any time while your account is open.
4. Account Suspension
Padelground may suspend or restrict access to memberships, bookings, facilities or services where:
- Fees remain unpaid;
- These Terms are breached;
- Safety concerns arise;
- Fraud is reasonably suspected; or
- Unlawful conduct is reasonably suspected.
5. Wallet
Your wallet is a stored-value account used for bookings, clinics, coaching, recovery sessions and other services at Padelground. Wallet credits:
- Do not expire;
- Are non-transferable between players;
- Are non-refundable to your original payment method, or redeemable for cash, except where required by the Australian Consumer Law or other applicable law;
- May be refunded to your wallet when you cancel a booking outside the applicable cancellation window;
- Where a bonus or promotional credit is added (for example a top-up bonus), the bonus portion is non-cash promotional credit and is not refundable to your original payment method.
Padelground may correct wallet balances resulting from system errors, duplicate credits, payment reversals, fraud or administrative mistakes.
Account closure. Closure of a Member account does not automatically extinguish wallet credit where permitted by law or where closure results from fraudulent or unlawful conduct. If Padelground permanently closes a site or ceases to operate, any unspent wallet credit will be handled in accordance with your rights under the Australian Consumer Law.
6. Privacy
Personal information is collected, used and disclosed in accordance with Padelground’s Privacy Policy.
7. Recovery Facilities — Sauna & Cold Plunge
Padelground provides recovery facilities including a sauna and cold plunge, available to eligible members and as a paid add-on to bookings. Use of these facilities is subject to these terms and to the separate Recovery Facilities Waiver (Sauna & Cold Plunge), which you must accept before first use.
Health acknowledgement. Sauna and cold-water immersion carry health risks, including but not limited to fainting, cardiovascular stress, burns and cold shock. You must not use these facilities if you have a condition that makes their use unsafe, if pregnant (without medical clearance), or while affected by alcohol or drugs. By using them you confirm you have read the health guidance, accepted the applicable waiver, and disclosed any relevant condition.
8. Fitness Classes & Studio
By booking a fitness class, the participant warrants that all information supplied in any health acknowledgement, medical screening form or waiver is accurate and complete.
Padelground may require a health acknowledgment, and a medical clearance where reasonably necessary for a specific elevated risk or where an individualised program is prescribed.
Padelground may require medical clearance where a participant discloses a relevant health risk, and may refuse or restrict participation only after an individual assessment of the specific safety risk where that risk cannot be managed by clearance or reasonable adjustment. Padelground will act consistently with applicable anti-discrimination laws.
Cancellation and capacity. Class cancellation follows the same window as your membership level (clause 2). Classes have limited capacity; booked spots not cancelled within the window are non-refundable (subject to the ACL). We may substitute instructors or adjust the timetable.
9. Open Match Terms
Open matches are player-organised group sessions. The organiser pays their share at creation. If the match does not reach the minimum player count, it is automatically cancelled 2 hours before the start time with a full refund to all paid players.
The organiser is not charged for unfilled public spots on open matches. This differs from regular split-payment bookings, where the organiser guarantees unpaid shares (clause 10).
Individual cancellation within the cancellation window results in forfeiture of that player’s share, and the spot reopens immediately for others to join.
10. Split Payment Terms
When booking for a group, the organiser pays their share and shares a payment link with other players. Partners can pay their share up to 1 hour after the session ends.
Organiser responsibility. For regular court bookings (not open matches): if partners do not pay within the deadline, unpaid shares are charged to the organiser’s wallet. If the wallet balance is insufficient, the remainder is recorded as an outstanding balance payable by the organiser. By creating a split-payment booking, the organiser expressly agrees to this responsibility, which is also shown at the point of booking.
11. Coaching Terms
Coaching sessions are provided by qualified coaches engaged by or affiliated with Padelground. By booking a coaching session, you confirm you have disclosed any relevant injury, medical condition or physical limitation to your coach.
Coaching cancellation follows the same window as your membership level. Sessions cancelled within the notice period are non-refundable, subject to the Australian Consumer Law.
12. League Terms
League registration fees cover the full season and are non-refundable once the season begins, subject to the Australian Consumer Law. Both players in a pair must be within the league’s rating range at the time of registration. Match results are final once confirmed by both teams or verified by club staff.
13. Force Majeure
Padelground will not be liable for delayed, interrupted or unavailable services caused by circumstances beyond its reasonable control, including severe weather events, utility failures, government directions, public health orders, natural disasters or emergencies.
14. Assumption of Risk and Health
Nature of the activities. Padel, coaching, group fitness classes, competitions and events, use of the courts, gym and equipment, and use of the recovery facilities are physical activities that involve obvious and inherent risks. These risks may result in injury, illness, aggravation of a pre-existing condition, property damage, permanent disability or death. Some of these activities may constitute a dangerous recreational activity involving a significant degree of risk of physical harm within the meaning of the Civil Liability Act 2003 (Qld).
Voluntary participation. You take part voluntarily and, to the fullest extent permitted by law, accept the obvious and inherent risks of the activities you choose to undertake. This clause operates together with, and does not limit, any separate waiver, assumption of risk or risk warning you accept for a particular activity (including the Adult, Minor, Fitness and Recovery Facilities waivers). Where a waiver you have accepted deals specifically with the risks of an activity, that waiver applies in addition to these terms.
Your health warranty. You warrant that you are medically fit to take part in the activities you book, that you have disclosed any relevant medical condition, injury or limitation, and that you will stop and seek assistance if you feel unwell or unsafe. You are responsible for obtaining your own medical advice where appropriate.
Pre-exercise screening. Where reasonably necessary having regard to the risk of a particular activity, Padelground may require you to complete a pre-exercise screening questionnaire (PAR-Q), risk acknowledgement or medical screening, and to provide medical clearance before taking part. Screening is applied on a consistent basis to help you take part safely, not to exclude you.
Clearance and adjustments. Where screening identifies a higher-risk factor, participation in the affected activity may be conditional on you first providing medical clearance from a qualified practitioner. A required clearance is a safety measure and cannot be bypassed or overridden; it is not a permanent exclusion, and participation will proceed once clearance (with any conditions noted) is provided. Padelground will consider reasonable adjustments to enable participation, and will only refuse or restrict participation after an individual assessment of a specific safety risk that cannot be managed by clearance or adjustment. Padelground will act consistently with applicable anti-discrimination laws.
15. Release of Other People's Conduct
Release. To the fullest extent permitted by law, you release Padelground and its directors, officers, employees, coaches, contractors, volunteers and agents from any claim, demand, action, loss, damage, cost or expense arising from or in connection with your participation in the activities or your use of Padelground’s facilities and equipment, except to the extent that any such liability is caused by Padelground’s negligence or cannot lawfully be excluded.
Conduct of other people. Padelground is not responsible for the acts or omissions of other members, participants, guests, spectators or other third parties, including any injury, loss or damage they may cause to you or your property, except to the extent caused by Padelground’s negligence or where liability cannot lawfully be excluded. You acknowledge that padel, open matches, classes and social sessions involve other people, and you accept the risks associated with their presence and conduct to the extent permitted by law.
Personal property. Padelground is not responsible for loss of, theft of, or damage to your personal belongings brought onto its premises, except to the extent caused by Padelground’s negligence or where liability cannot lawfully be excluded. Please keep valuables secure; any lockers or storage provided are used at your own risk.
16. Liability for Loss and Responsibilities
Your conduct. You must comply with all venue rules, safety requirements and reasonable directions of staff, use the facilities and equipment safely and for their intended purpose, behave respectfully towards others, and promptly report any injury, unsafe condition or damaged equipment. Padelground conducts its fitness services consistently with the Fitness Industry Code of Practice (Queensland).
Loss or damage you cause. You are responsible for any loss or damage you cause to Padelground’s property, facilities or equipment, or to another person or their property, arising from your intentional, reckless, negligent or unlawful conduct, or your breach of these terms. You agree to indemnify Padelground against any such loss, damage, cost or claim to that extent. This clause does not apply to the extent the loss is caused by Padelground’s negligence, or to any liability that cannot lawfully be excluded.
Guests. Where you bring or organise guests or other players, you are responsible for ensuring they are eligible to take part, have accepted any required waiver, and comply with these terms and the venue rules.
17. Limitation of Liability
Recreational services. To the extent permitted by law, including section 139A of the Competition and Consumer Act 2010 (Cth), liability arising from the supply of recreational services for death or personal injury is excluded where such liability may lawfully be excluded. This exclusion does not apply to liability for death or significant personal injury caused by Padelground’s reckless conduct.
Consequential loss. To the fullest extent permitted by law, Padelground is not liable for any indirect, consequential or economic loss arising in connection with these terms or your use of Padelground’s services or facilities.
Limit of liability. Where Padelground is liable to you for a failure to comply with a consumer guarantee in relation to services, and the guarantee is one that may lawfully be limited, Padelground’s liability is limited, at its option, to supplying the services again or paying the cost of having the services supplied again.
Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
18. General
Changes to these terms. We may update these terms from time to time. Material changes will be notified to members with reasonable notice. Continued use after a change takes effect constitutes acceptance. If a change materially and adversely affects you, you may cancel your membership or stop using our services before the change takes effect, at no cost.
Governing law. These terms are governed by the laws of Queensland, Australia.
Dispute resolution. If a dispute arises, please contact us first so we can try to resolve it. Before starting court proceedings (except for urgent interlocutory relief), a party must give written notice of the dispute, and the parties must attempt in good faith to resolve it, including through mediation if it is not resolved within a reasonable time. Nothing in this clause prevents you from exercising your rights under the Australian Consumer Law or from bringing a matter before the Queensland Civil and Administrative Tribunal or a court of competent jurisdiction.
Severability. If any provision of these terms is invalid or unenforceable, it is to be read down or severed to the extent necessary, and the remaining provisions continue in full force and effect.
Assignment. You may not assign or transfer your rights under these terms without our prior written consent. We may assign, novate or transfer our rights and obligations, including on a sale or restructure of the business, and will give you reasonable notice where required.
No waiver. A failure or delay by Padelground in exercising a right under these terms is not a waiver of that right, and a single or partial exercise does not prevent any further exercise of it.
Entire agreement. These terms, together with your membership terms and any waiver or risk acknowledgement you accept for a particular activity, form the entire agreement between you and Padelground about your use of our services and supersede any prior representations or understandings.
Notices. We may give you notices by email, through your member profile or the app, or by notice at the venue. You may contact us using the details published on our website.
Australian Consumer Law: Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be lawfully excluded, restricted or modified. Where Padelground fails to provide a service with due care and skill, or a service is not fit for its stated purpose, you may be entitled to a remedy regardless of the cancellation or refund rules.
Account Terms & Conditions
Platform terms · Effective 1 May 2026
The following terms govern your account and your use of the platform, in addition to the club terms above.
1. About the Platform
The platform operator ("we", "us") operates a digital marketplace that connects padel players with independent club operators. These Terms govern your use of the platform, including the website, mobile app, and all related services.
By creating an account or using the platform you agree to these Terms. If you do not agree, do not use the platform.
2. Eligibility
You must be at least 18 years old to create an account. Players aged 16–17 may use the platform with the consent of a parent or legal guardian who accepts these Terms on their behalf.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current information and update it promptly if it changes.
4. Platform Role
The platform provides the technology. Each club operates independently and is responsible for its own facilities, pricing, staff, and services. The platform operator is not a party to the contract between you and the club for any booking, membership, or service.
5. Payments
Payments are processed via Stripe and stored-value wallet. All prices displayed are in Australian Dollars (AUD) and include GST unless stated otherwise. You authorise us to charge your selected payment method for any bookings, memberships, or services you purchase.
6. Intellectual Property
All content, trademarks, and technology on the platform are owned by or licensed to the platform operator. You may not reproduce, modify, or distribute any part of the platform without our prior written consent.
